GENERAL CONDITIONS OF AFTER-SALES SERVICE

ARTICLE 1. SUBJECT

1.1 These After-Sales Service General Terms and Conditions govern the relationship between BACK2BUZZ and its Clients, whether they are professionals, individuals or consumers placing orders directly with BACK2BUZZ or via its partners. They complete BACK2BUZZ's General Terms and Conditions of Sale (GTCS) to which they expressly refer.

1.2 Any request for intervention made to BACK2BUZZ's After-Sales Service implies full and unconditional acceptance of these General Terms and Conditions of After-Sales Service.

1.3 Back2buzz reserves the right to modify these Terms and Conditions at any time without notice to the Customer. You may consult the most recent version of these Terms and Conditions at any time at the following address: https://www.back2buzz.be/

ARTICLE 2. SAV PROCEDURE

2.1 Unless otherwise stipulated in the special warranty conditions, the goods to be repaired must be sent to the site indicated by the After Sales Service.

2.2 The Customer must complete the Breakdown Declaration form on the https://www.back2buzz.be/ After-Sales Service category website.

ARTICLE 3. QUOTATION

3.1 The Customer is informed that a quotation is not issued free of charge. The cost of drawing up an estimate varies according to the goods to be repaired. The Customer will confirm his agreement to the cost of the estimate by signing the "Estimate" returned by e-mail. The cost of drawing up the quotation will be deducted from the final invoice if accepted by the Customer. Otherwise, they will be the subject of a separate invoice.

3.2 The quotation is valid for 30 (thirty) calendar days from its date.

3.3 If the quotation is accepted, the Customer must send it to the after-sales service, duly signed, within the 30 (thirty) day period referred to in article 3.1 above. Failing this, the Customer will be deemed to have refused the quotation and will have a period of one month from the expiry of the 30-day period to recover the goods concerned. On this occasion, the Customer must pay the costs of drawing up the quotation referred to in article 3.1 above. If the goods in question are not collected within this period, article 6 will apply. In any event, the cost of drawing up the quotation will remain payable.

3.4 If the repair work involves major work that results in a change to the amount of the quotation or to the indicative times mentioned therein, the Customer will be notified immediately by any means, and in particular by a corrected quotation free of charge. No repairs will be carried out without the Customer's express prior agreement. In this respect, the terms of article 3.3 above shall apply in full.

ARTICLE 4. PACKAGES

4.1 In addition to repairing the goods entrusted to it, the After Sales Service may offer the Customer services to restore the goods to their original condition for a fixed price. The Customer will confirm his agreement to these fixed-price services by signing the "Quotation".

4.2 If, in the course of carrying out the flat-rate repair services, it proves necessary to replace a key part of the goods concerned, the After Sales Service will draw up, free of charge, an estimate corresponding to the cost of the spare part and labour. This "out-of-pocket" estimate will be accepted or refused by the Customer under the terms of article 3.3 above. In the event that the "out of package" estimate is refused, BACK2BUZZ cannot be held responsible for any subsequent malfunction of the merchandise in question, due to the defective part that it would have identified in the "out of package" estimate.

ARTICLE 5. REPAIRS

5.1 Under no circumstances may repairs lead to an extension of the warranties previously granted, in particular the warranty(s) given at the time of sale.

5.2 BACK2BUZZ reserves the right to either carry out the requested repairs or replace the delivered equipment with equivalent equipment. The Customer may automatically request the replacement of the merchandise in the event that BACK2BUZZ is unable to carry out the required repairs within 30 (thirty) calendar days from the expiry of the indicative deadline announced to the Customer, either for repairs under the warranty.

5.3 In the event of a deadline extension under the aforementioned conditions, BACK2BUZZ shall not be required to lend replacement merchandise, either before or during the repair.

5.4 When they are due, repair costs are payable in cash, net without discount, on the date on which the Customer takes back the repaired goods from the After Sales Service, unless special conditions apply.

ARTICLE 6. DEFECTS DETECTED ON COLLECTION OF THE PRODUCT

6.1 The Customer will be notified by email when the goods are ready.

6.2 If the goods entrusted to BACK2BUZZ are not picked up within one month of the notification provided for in Article 6.1 above, a reminder will be sent to the Client by registered letter with acknowledgement of receipt. If the Customer does not respond within 8 (eight) days following receipt of this letter, the merchandise will be destroyed or made available to BACK2BUZZ.

6.3 No compensation of any kind or amount whatsoever may be claimed by the Customer from BACK2BUZZ.

ARTICLE 7. COMPLAINTS

7.1 Any complaint from the Customer following repair services must be sent by registered letter with acknowledgement of receipt to the BACK2BUZZ head office after-sales service department that carried out said repair, within 48 hours (as evidenced by the postmark) of the return of the merchandise by the Customer.

7.2 BACK2BUZZ will endeavour to respond as quickly as possible.

ARTICLE 8. JURISDICTION CLAUSE

IN THE EVENT OF ANY DISPUTE OF ANY NATURE WHATSOEVER RELATING TO THESE GENERAL TERMS AND CONDITIONS OF AFTER-SALES SERVICE, THE COMMERCIAL COURT AT THE REGISTERED OFFICE OF OUR COMPANY SHALL HAVE SOLE JURISDICTION. THIS CLAUSE APPLIES EVEN IN THE EVENT OF AN INCIDENTAL CLAIM, MULTIPLE DEFENDANTS OR A GUARANTEE CLAIM, AND REGARDLESS OF THE METHOD AND TERMS OF PAYMENT.

ARTICLE 9. PRODUCTS NOT COVERED BY WARRANTY OR REJECTION OF WARRANTY

LES PRODUITS NON COUVERTS PAR LA GARANTIE TEL QUE LES DOMMAGES RÉSULTANTS D’UN DÉFAUT DE SOIN OU D’ENTRETIEN CONFORMÉMENT AUX NOTICES ET SPÉCIFICATIONS TECHNIQUES, LES DOMMAGES D’ORIGINE EXTERNE (CASSE, OXYDATION), LES DOMMAGES CONSÉCUTIFS À UNE UTILISATION NON-CONFORME OU INAPPROPRIÉE DES PRODUITS, LES DOMMAGES CONSÉCUTIFS À L’INTERVENTION PAR UN RÉPARATEUR NON-AGRÉÉ PAR BACK2BUZZ OU PAR LE CONSTRUCTEUR S’AGISSANT DES PRODUITS NEUFS OU RECONDITIONNÉS PAR BACK2BUZZ, DONNERONT LIEU À UNE FACTURATION DU DIAGNOSTIC ET DU TRANSPORT RETOUR D’UN MONTANT DE 30€ TTC.
